These terms explain the rules for using BrandieMichelle.com and the general terms that apply when you purchase or participate in services, consulting, marketing campaigns, events, workshops, memberships, digital products or other paid offerings provided by Brandie Michelle Peters.
By using this website or purchasing an offering, you agree to the applicable terms described below, together with any additional terms presented for the specific service you purchase.

If you purchase something from me, I will make a reasonable professional effort to provide what was described. In return, you are responsible for providing the information, access, materials, cooperation and payment required for me to do the work. Marketing and business outcomes are influenced by many things neither of us completely controls, so strategies, projections and goals are not guarantees unless a specific written agreement explicitly says otherwise.
ACCEPTANCE OF THESE TERMS
These Terms of Use + Terms of Service (“Terms”) apply to your use of BrandieMichelle.com and, where applicable, services and offerings provided professionally by Brandie Michelle Peters.
By accessing this website, purchasing an offering, registering for a paid program, booking a paid service or otherwise entering into a professional engagement with me, you agree to the applicable portions of these Terms.
If you do not agree with these Terms, please do not purchase or use the applicable paid service.
SERVICES + OFFERINGS
My professional offerings may include, now or in the future:
The specific scope, price, timeline, deliverables and conditions for an offering are those described on the applicable sales page, checkout page, proposal, invoice, statement of work or written agreement.
Not every provision on this page will apply identically to every offering.
WHEN AN OFFER HAS ITS OWN TERMS
Some consulting projects, marketing services, campaigns, retainers, collaborations or other engagements may include their own proposal, contract, statement of work or written terms.
If those specific terms conflict with these general Terms, the more specific written agreement will govern that engagement to the extent of the conflict.
PRICING + PAYMENT
Prices are displayed or communicated before purchase and may be quoted in Canadian dollars, U.S. dollars or another clearly identified currency.
By completing a purchase, you authorize the applicable payment processor to charge the payment method you provide for the amount displayed or otherwise agreed upon.
Payment may be required in full before work begins unless a payment plan, retainer arrangement or other schedule has been specifically agreed upon.
You are responsible for ensuring that your billing information is accurate and that payments can be successfully processed.
SUBSCRIPTIONS + RECURRING PAYMENTS
Some memberships, retainers, subscriptions or services may renew automatically.
When you select a recurring offering, you authorize recurring charges according to the billing frequency and price disclosed at the time of purchase until the subscription is cancelled or otherwise ends.
Cancelling a recurring subscription generally prevents future renewal charges. It does not automatically refund charges that were already properly processed before cancellation.
Any offering-specific cancellation conditions disclosed when you purchase will also apply.
I NEED YOU TO PARTICIPATE TOO
Consulting and marketing work usually requires cooperation from both sides.
Depending on the service, you may be responsible for providing:
- Accurate and complete information.
- Necessary website, platform or account access.
- Brand assets, copy, images or other materials.
- Timely feedback or approvals.
- Functional registration, checkout or landing pages.
- Appropriate permissions for materials you provide.
- Attendance at scheduled meetings or calls.
- Decisions required to move a project forward.
- Compliance with laws and regulations applicable to your own business.
Delays in providing required materials, information, access, feedback or approvals may delay the work or affect the results reasonably achievable during the engagement.
NO GUARANTEE OF BUSINESS RESULTS
Marketing is influenced by many factors, including your offer, audience, positioning, price, reputation, timing, market conditions, competition, platform behaviour, algorithms, sales process and customer decisions.
I do not guarantee any specific level of revenue, profit, sales, leads, customers, followers, reach, website traffic, engagement, conversion rate, event attendance or other business result.
Past results, case studies and examples are provided as context and do not guarantee that another person or business will experience the same outcome.
EVENT REGISTRATION SERVICES
If you purchase an event promotion or event registration campaign, any stated registration number is a campaign goal rather than a guaranteed minimum unless your individual written agreement expressly states otherwise.
Registration performance can be affected by the event topic, audience fit, timing, landing page, registration process, positioning, geographic restrictions, scheduling, competition and other factors.
You are responsible for maintaining a functional registration page, delivering the event, communicating with registrants and fulfilling any promises made to attendees unless those responsibilities are specifically included in the service purchased.
REGISTRATIONS VS. ATTENDANCE
A registration does not guarantee that the registrant will attend the event. Attendance decisions remain with individual registrants and may be affected by reminders, scheduling, event timing and other factors.
PROMOTIONAL CHANNELS
I retain reasonable discretion over how and where I promote an event through my own audiences, communities, partner opportunities and other channels available to me.
Access to a particular group, community, audience or platform does not guarantee that a particular post will receive a specific amount of reach or engagement.
AUDIENCE + OFFER FIT
I reserve the right to decline an event or campaign that I reasonably determine is not appropriate for my audience, communities, professional reputation or promotional relationships.
I may also stop promoting an event if material information about the event, offer or business was misrepresented or if continuing to promote it could reasonably harm my audience, communities or professional relationships.
PROFESSIONAL JUDGMENT + ADVICE
Consulting involves professional judgment, discussion, strategy and recommendations based on the information available at the time.
You remain responsible for your business decisions and for determining whether a recommendation is appropriate for your circumstances.
You are not required to implement every recommendation I make.
Marketing or business consulting is not legal, accounting, tax, investment, medical or mental health advice. Where a decision requires regulated professional expertise, you should consult an appropriately qualified professional.
SCHEDULING + RESCHEDULING
If your service includes a scheduled call, workshop, consultation or meeting, please arrive on time and prepared.
If you need to reschedule, please provide as much notice as reasonably possible.
Repeated cancellations, missed appointments or significant delays may require the service to be rescheduled, shortened or otherwise adjusted.
If I need to reschedule due to illness, emergency, technology failure or another reasonable circumstance, I will make a reasonable effort to provide an alternate time.
REFUND POLICY
Refund eligibility depends on the type of offering purchased and any specific terms displayed at checkout or agreed to in writing.
CONSULTING + DONE-FOR-YOU SERVICES
Because consulting and done-for-you services reserve professional time and may involve preparation or work beginning shortly after purchase, payments are generally non-refundable once substantial work has begun, except where otherwise required by law or specifically agreed in writing.
COMPLETED SERVICES
Services that have already been substantially or fully delivered are generally not eligible for refund simply because the purchaser later decides not to use the advice, materials, strategy or deliverables.
DIGITAL PRODUCTS + DOWNLOADS
Because digital products can often be accessed immediately, digital purchases may be final sale once access or delivery has occurred, subject to applicable law and any specific guarantee displayed with the product.
MEMBERSHIPS + SUBSCRIPTIONS
Cancellation of a membership or subscription stops future renewals according to the applicable billing terms. Previously processed membership payments are generally not prorated or refunded solely because the member did not use the membership.
EVENTS + WORKSHOPS
Refund and transfer rules for paid events or workshops may vary and will be communicated with the applicable event where necessary.
BILLING QUESTIONS + PAYMENT DISPUTES
If you believe you were charged incorrectly or have a legitimate concern about a purchase, please contact me so the issue can be reviewed.
A chargeback should not be used as a substitute for contacting me about a normal billing, cancellation or service concern.
I reserve the right to provide transaction records, agreements, correspondence, access records and evidence of services delivered when responding to a payment dispute.
CONTENT YOU PROVIDE TO ME
You retain ownership of original materials you provide for use in your project.
You grant me permission to use those materials as reasonably necessary to perform the service you purchased.
You are responsible for ensuring you have the necessary rights and permissions to use any logos, photographs, copy, trademarks, videos, testimonials, data or other materials you provide.
INTELLECTUAL PROPERTY
Unless otherwise agreed in writing, my pre-existing frameworks, processes, templates, methodologies, educational materials, systems, concepts, website content, branding and other intellectual property remain mine.
Purchasing consulting or a service does not automatically transfer ownership of my underlying methodology or reusable business systems.
Where a service includes custom deliverables, your rights to those deliverables will be determined by the applicable service description or agreement.
COURSES, WORKSHOPS + RESOURCES
Paid educational materials are generally licensed for the purchaser’s personal or internal business use.
Unless permission is specifically granted, you may not reproduce, resell, redistribute, publish, upload, share access to or commercially exploit substantial portions of paid materials.
PRIVATE BUSINESS INFORMATION
During consulting or professional work, we may each become aware of non-public business information belonging to the other.
I will make reasonable efforts to treat clearly confidential client information appropriately and use it only as reasonably necessary to provide the service or operate the engagement.
Confidentiality does not generally apply to information that is already public, independently developed, lawfully obtained from another source or required to be disclosed by law.
CASE STUDIES + CLIENT EXPERIENCES
Testimonials and case studies reflect the experience of the person or business described.
They are not guarantees that every client or customer will receive the same result.
I will not intentionally publish confidential client information as a case study without appropriate permission or another legitimate basis for doing so.
THIRD-PARTY PLATFORMS + SERVICES
My work may involve third-party platforms such as social networks, advertising platforms, website software, email services, payment processors, scheduling platforms, automation systems and other technology providers.
I do not control those companies, their algorithms, availability, policies, technical decisions or account enforcement.
I am not responsible for losses caused solely by an independent third-party platform outage, policy change, suspension, algorithm change or other event outside my reasonable control.
AI + AUTOMATION IN MY WORK
I use artificial intelligence, automation and other software tools as part of my professional workflow.
These tools may assist with research support, brainstorming, organization, analysis, copy, coding, design exploration, image creation, technical work, marketing and other professional tasks.
Use of these tools does not remove my responsibility to exercise professional judgment over the work I provide.
Because AI-generated information can contain errors, important factual, legal, financial or regulated decisions should be independently verified where appropriate.
ACCEPTABLE USE
You may use this website for lawful personal and business purposes.
You may not intentionally:
- Interfere with the operation or security of the website.
- Attempt unauthorized access to accounts, systems or restricted areas.
- Introduce malicious software or harmful code.
- Scrape or systematically reproduce protected content in a manner that violates applicable rights or law.
- Impersonate me or falsely represent an affiliation with my business.
- Use my website or content for unlawful, fraudulent or abusive purposes.
TERMINATION OF SERVICES
Either party may end an ongoing engagement where permitted by the applicable service agreement.
I reserve the right to suspend or terminate a professional relationship for serious non-payment, abuse, harassment, unlawful conduct, material misrepresentation, repeated failure to cooperate or conduct that makes continued performance unreasonable.
If an engagement ends early, payment and refund obligations will depend on work already completed, time reserved, expenses incurred and the specific terms of that engagement.
FORCE MAJEURE + UNEXPECTED EVENTS
Neither party should be treated as having intentionally failed to perform because of circumstances genuinely outside their reasonable control.
This can include serious illness, emergency, natural disaster, widespread technology failure, internet outage, government action, labour disruption, platform outage or another comparable event that materially prevents performance.
Where practical, affected work will be rescheduled, adjusted or otherwise addressed reasonably.
LIMITATION OF LIABILITY
To the extent permitted by applicable law, I am not responsible for indirect, consequential, incidental, special or speculative losses arising from your use of this website or implementation of general information provided here.
For paid services, any liability will be subject to applicable law and any limitations contained in the specific agreement governing the engagement.
Nothing in these Terms is intended to exclude or limit a right or remedy that cannot legally be excluded or limited.
YOUR BUSINESS REMAINS YOUR BUSINESS
You retain control over and responsibility for your business, offers, customers, advertising claims, financial decisions, legal compliance and implementation decisions.
My involvement as a consultant, marketer, strategist, educator or service provider does not make me an owner, officer, employee, fiduciary or legal representative of your business unless a separate written agreement expressly creates such a relationship.
CANADIAN + ALBERTA LAW
Unless another written agreement validly provides otherwise, these Terms are governed by the applicable laws of the Province of Alberta and the federal laws of Canada applicable in Alberta.
Nothing in this section removes consumer or other statutory rights that applicable law does not permit the parties to waive.
UPDATES TO THESE TERMS
I may update these Terms as my website, services, technology or business practices evolve.
The date at the top of this page identifies the current version.
Changes to general website terms apply prospectively. Existing paid engagements remain subject to the terms applicable to that engagement and applicable law.
